Welcome to BrightHarborBay ("we," "us," or "our"). These Terms & Conditions ("Terms") are applicable to your use of our luxury yacht chartering services and the website located at brightharborbay.sbs (collectively referred to as the "Service"), which is provided by BrightHarborBay.
By securing a charter or utilizing our Service, you consent to adhere to these Terms. Should you not agree with any segment of these terms, then you may not access the Service.
2. Service Overview
BrightHarborBay offers an array of top-tier yacht chartering services, which includes but is not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Allocation of services depends on availability and climate conditions. We have the authority to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, the following requirements must be fulfilled:
- Minimum age of 18 years
- Submission of accurate and comprehensive information
- Payment of the necessary deposit as indicated in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Booking is deemed confirmed only with the successful processing of your payment and receiving our confirmation in writing. We maintain the discretion to decline service to any individual.
3.3 Availability
Availability of charters is contingent on the accessibility of vessels and favorable weather conditions. We strive to accommodate your requested dates and times within reason.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the overall charter fee required at the time of booking
- Balance: Payable 48 hours prior to the departure of your charter
- Supplementary charges (if any): Payable upon the completion of your charter
4.3 Payment Methods
We accept a variety of payment methods including major credit cards, bank transfers, and certified cheques, all processed through secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Refund available after deduction of processing fees
- From 24 to 72 hours before departure: Refund of 50%
- Less than 24 hours prior to departure: No refund provided
5.2 Weather Cancellations
In the event our captain deems weather conditions as hazardous, we will propose to:
- Reschedule your charter to another suitable date at no extra cost
- Issue a full refund when rescheduling is unfeasible
5.3 Mechanical Issues
In the case of mechanical failure with the designated yacht, we will attempt to offer an appropriate substitute. If no suitable alternative is available, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Comply with all instructions given by the crew
- Utilize provided safety gear as necessary
- Inform about any health conditions that may impact their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
The following articles are prohibited on board:
- Glassware
- Illegal substances
- Weapons of any kind
- Substances that exceed moderate personal consumption
- Pets (exception only with prior approval)
6.3 Conduct
Passengers must behave respectfully. Any actions endangering safety or disrupting others' enjoyment may lead to an early termination of the charter without any refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the cost paid for the charter. We are not accountable for:
- Injuries sustained due to passenger negligence
- Theft or destruction of personal belongings
- Non-direct, opportunistic, or penalty damages
- Interruptions caused by weather or events outside our control
7.2 Insurance Coverage
We maintain comprehensive marine insurance which covers our fleet and operations. Guests are responsible for securing their travel and personal insurance.
7.3 Assumption of Risk
Engagement in our charter services implies that you understand marine activities have inherent dangers and you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We reserve the right to adjust plans, voyages, or timetables as required due to weather, safety, or operational demands. We will endeavor to provide similar alternative experiences.
9. Force Majeure
Our operation is not responsible for delays, cancellations, or changes propelled by factors beyond our control, inclusive of but not limited to:
- Extreme weather
- Natural catastrophes
- Mandates from government authorities
- Port shutdowns
- Machinery breakdown
10. Privacy and Data Protection
We handle your personal details in agreement with our Privacy Policy. By utilizing our services, you consent to our collection and use of your data as stated in the Privacy Policy.
11. Intellectual Property
Our website's content, including but not limited to text, imagery, logos, and graphics, is safeguarded by copyright and trademark regulations. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited without our explicit permission.
12. Governing Law
These Terms are subject to the jurisdiction of the laws in Montenegro. Any disputes will be resolved in the courts situated in Tivat, Montenegro.
13. Changes to Terms
We reserve the prerogative to revise these Terms at any time. New versions will be available on our website along with an updated revision date. Using our services post-modification implies acceptance of the new terms.
